Partner Visas

 Partners include: 

·        applicants intending to get married (fiancés)

·        married partners

·        de facto partners (including those in a same sex relationship)

 

The applicant’s partner must be:

·        an Australian citizen, or

·        an Australian permanent resident, or

·        an eligible New Zealand citizen

Offshore application - Subclass 309 (Temporary) and Subclass 100 (Permanent)

The temporary visa (subclass 309) is for applicants from overseas to enter and stay in Australia with their partner. After two years they can apply for a permanent visa (subclass 100) and provided the relationship is genuine and ongoing, a permanent visa should be granted. Applicants apply for both a temporary visa and a permanent visa by completing and lodging the one application.

 

Offshore application - Prospective Marriage Visa - Subclass 300 (Temporary)

The temporary visa is for applicants from overseas to enter Australia and marry their fiancé. Once married, holders of this visa can then apply for a Partner visa to remain permanently in Australia.

Onshore application - Subclass 820 (Temporary) and Subclass 801 (Permanent)

The temporary visa (subclass 820) is for applicants to stay in Australia with their partner. After two years they can apply for a permanent visa (subclass 801) and provided the spousal relationship is genuine and ongoing, a permanent visa should be granted. Applicants apply for both a temporary visa and a permanent visa by completing and lodging the one application.
